Justice Joymalya Bagchi pressed Meta on the commercial value of behavioural metadata even when anonymised or kept separate from message content—the same distinction dating platforms routinely deploy when defending their data practices. Meta's legal team maintained that end-to-end encryption prevents access to WhatsApp message content and that the contested 2021 policy update 'did not weaken core protections' or enable chat data to fuel advertising systems, according to arguments presented in court. Yet the court's scepticism about 'meaningful consent' in markets with low digital literacy applies with particular force to dating apps, where privacy policies routinely exceed 10,000 words and data-sharing terms are accepted by users desperate to access a service with few substitutes. A 2023 study by the Internet Freedom Foundation found that dating app privacy policies in India averaged 12,400 words and required university-level reading comprehension—hardly accessible to the fruit seller Chief Justice Kant invoked.
What makes the WhatsApp case particularly relevant is the court's rejection of the 'take it or leave it' defence.
Meta argued users retain choice because they can stop using WhatsApp. The justices dismissed this as illusory given WhatsApp's dominance in a market where the platform functions as essential infrastructure for everything from family communication to small business transactions. Operators who've structured their data practices around the assumption that lengthy terms of service constitute valid consent should watch what happens when the Ministry of Electronics and Information Technology—added to the case at the Competition Commission's suggestion—decides to apply similar scrutiny. The court adjourned until 9 February and demanded more detailed explanations of Meta's data monetisation practices, including precisely how anonymised or siloed metadata feeds advertising and AI systems across the company's ecosystem.
What happens when the model breaks
The timing is particularly awkward for dating platforms ramping up AI deployment. Match Group has indicated that generative AI features will expand across its portfolio in 2025, whilst Bumble announced plans to use AI for everything from conversation suggestions to 'deception detection'. These systems require vast amounts of behavioural training data—the same data Indian regulators are now questioning whether users ever meaningfully agreed to share.
